Terms and Conditions

  1. 1.

    Information on how to enter forms part of the terms of entry. Entry into the competition is deemed acceptance of these terms and conditions.

  2. 2.

    Entry is open to all residents of Australia. However, employees, contractors and their immediate families of Optus Administration Pty Ltd, Salmat IDR Pty Ltd and their associated agencies and companies are not eligible to enter.

  3. 3.

    The competition commences on Saturday 1st October 2011 at 00:01 (AEST) and concludes on Sunday 8th April 2012 at 23:59 (AEST).

  4. 4.

    TIER 1: SMS & Vote / Game of Chance Component: To enter, participants must send a text/SMS message to 199 888 11 containing their full name, state and the name of their favourite A-League Team. Each SMS entry cost is $0.55 (including GST). SMS entrants will receive a reply message.

  5. 5.

    The SMS entry mechanic is only open to consumers with a SMS compatible mobile phone connected to a service provider which permits text messaging to the promotional SMS number. It is recommended that entrants check with their individual service provider in this regard.

  6. 6.

    Entrants under the age of 18 must obtain the prior permission of a parent or guardian over the age of 18 to enter.

  7. 7.

    Incomplete and incomprehensible entries will be deemed invalid.

  8. 8.

    Entrants in the competition may enter as many times as they like.

  9. 9.

    The Promoter reserves the right to request winners to provide proof of identity, proof of residency at the nominated prize delivery address and/or proof of entry validity (including phone bill) in order to claim a prize. Proof of identification, residency and entry considered suitable for verification is at the discretion of the Promoter. In the event that a winner cannot provide suitable proof, the winner will forfeit the prize in whole and no substitute will be offered.

  10. 10.

    The Promoter reserves the right to verify the validity of entries and to disqualify any entry which, in the opinion of Promoter, includes objectionable content, profanity, potentially insulting, inflammatory or defamatory statements, disqualify any entrant who tampers with the entry process, who submits an entry that is not in accordance with these Terms & Conditions of Entry or who has, in the opinion of Promoter, engaged in conduct in entering the Promotion which is fraudulent, misleading, deceptive or generally damaging to the goodwill or reputation of the Promotion and/or Promoter. The Promoter reserves the right to disqualify a winner if Promoter becomes aware that the winner and/or the winner's entry is of a type described in this clause.

  11. 11.

    Entries must be received by 23:59 (AEST/AEDT) on Sunday 8th April 2012 to be included in a draw for their chance to win $25,000 cash. The time of entry will in each case be the time the SMS message is received by the Salmat IDR database. The Promoter accepts no responsibility for any late, lost or misdirected entries including SMS messages not received by the Promoter or delays in the delivery of the SMS message due to technical disruptions, network congestion or for any other reason. SMS entries via the internet or computer generation and not attributable to a valid mobile phone account is invalid and will not be accepted.

  12. 12.

    TIER 2: A-League Teams / Game of Skill Component: The two A-League teams who get the highest SMS tally in the Tier 1 component of the competition will win a cash prize as detailed in Clause 13.

  13. 13.
    • TIER 1:

      1 x drawn winner will receive $25,000 cash.

    • TIER 2:

      The A-League team with the highest SMS tally will win $50,000 cash.

    • The A-League team with the second highest SMS tally will win $25,000 cash.
  14. 14.

    The total maximum prize value for both Tiers is $100,000.

  15. 15.

    Prizes are stated in Australian dollars and will be awarded as a cheque or electronic funds transfer (as the discretion of the Promoter).

  16. 16.

    Prizes cannot be transferred.

  17. 17.

    If the prize is unavailable, for whatever reason, the Promoter reserves the right to substitute the prize for a prize of equal or greater value, subject to State Regulation.

  18. 18.

    Once prizes have left the Promoter's premises, the Promoter takes no responsibility for prizes damaged, delayed or lost in transit.

  19. 19.

    By accepting the prize, the winner agrees to participate in and co-operate as required with all reasonable media editorial requests relating to the prize, including but not limited to, being interviewed, photographed or filmed.

  20. 20.

    In the event that for any reason whatsoever a winner does not take an element of the prize at the time stipulated by the Promoter then that element of the prize will be forfeited by the winner and cash will not be awarded in lieu of that element of the prize.

  21. 21.

    Independent financial advice should be sought as tax implications may arise as a result of accepting the prize.

  22. 22.

    Each valid entrant who has entered the competition over the duration of the promotional period will be entered into the major draw. The draw will be conducted at 11:00 am (AEST) on Monday 9th April 2012. If any particular draw is scheduled on a public holiday, the draw will be conducted on the next business day. The draw will be conducted at Salmat IDR, Level 2, 116 Miller Street, North Sydney NSW 2060.

  23. 23.

    The winners will be notified within 2 days of the draw. The winner will be notified of their prize in writing and their details will be published in the Public Notices section of The Australian newspaper on Thursday 19th April 2012.

  24. 24.

    Prizes will be awarded to person named in the entry. However, in a dispute, will be awarded to the account holder of the entry mechanism used to submit their entry (i.e. mobile phone account holder or land line account holder).

  25. 25.

    Should an entrant's contact details change during the promotional period, it is the entrant's responsibility to notify the Promoter. A request to access or modify any information provided in an entry should be directed to Promoter.

  26. 26.

    Subject to any written direction given under relevant State legislation, an unclaimed prize draw will take place at Salmat IDR, Level 2, 116 Miller Street, North Sydney NSW 2060 on Monday 9th July 2012 at the same time and place as the original major draw and any winner will be notified in writing and will have their details published in the Public Notices section of the Australian Thursday 19th July 2012.

  27. 27.

    The promoter's decision is final and the promoter will not enter into correspondence regarding the Competition result.

  28. 28.

    It is a condition of accepting the prize that the winner must comply with all the conditions of use of the prize and the prize supplier's requirements.

  29. 29.

    It is a condition of accepting the prize that the winner may be required to sign a legal release in a form determined by the promoter in its absolute discretion.

  30. 30.

    In the case of the intervention of any outside act, agent or event which prevents or significantly hinders the Promoter's ability to proceed with the competition on the dates and in the manner described in these terms and conditions, including but not limited to vandalism, power failures, tempests, natural disasters, acts of God, civil unrest, strike, war, act of terrorism, the Promoter may in its absolute discretion cancel the competition and recommence it from the start on the same conditions, subject to any written directions given under State Regulation.

  31. 31.

    The Promoter shall not be liable for any loss or damage whatsoever which is suffered (including but not limited to indirect or consequential loss) or for any personal injury suffered or sustained in connection with any prize/s except for any liability which cannot be excluded by law. The Promoter is not responsible for any incorrect or inaccurate information, either caused by the phone user or for any of the equipment or programming associated with or utilised in this competition, or for any technical error, or any combination thereof that may occur in the course of the administration of this competition including any omission, interruption, deletion, defect, delay in operation or transmission, communications line or telephone, mobile or satellite network failure, theft or destruction or unauthorised access to or alteration of entries.

  32. 32.

    The Promoter reserves the right in its sole discretion to disqualify any individual who the Promoter has reason to believe has breached any of these conditions, or engaged in any unlawful or other improper misconduct calculated to jeopardise the fair and proper conduct of the promotion. The Promoter's legal rights to recover damages or other compensation from such an offender are reserved.

  33. 33.

    Optus Administration Pty Ltd, Salmat IDR Pty Ltd and their associated agencies and companies assume no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission; communications line failure, theft or destruction or unauthorised access to, or alteration of entries, and reserves the right to take any action that may be available.

  34. 34.

    If for any reason this competition is not capable of running as planned, including due to infection by computer virus, bugs, tampering, unauthorised intervention, fraud, technical failures or any causes beyond the control of the Promoter, which corrupt or affect the administration, security, fairness or integrity or proper conduct of this promotion, the Promoter reserves the right in its sole discretion to disqualify any individual who tampers with the entry process, take any action that may be available, and to cancel, terminate, modify or suspend the competition, subject to any written direction given under State Regulation.

  35. 35.

    All entries become the property of The Promoter. The Promoter collects personal information about you to enable you to participate in this promotion but no further use of this information will be made without prior consent. All opt-in entries will be entered into a database and The Promoter may use the entrant's names, addresses and telephone numbers for future promotional, marketing and publicity purposes in any media worldwide without notice and without any fee being paid unless otherwise advised by the entrant. By opting-in, entrants confirm that they allow their details to be used for this purpose. If entrants no longer consent to their details being used for future marketing purposes, the entrant should contact The Promoter on their details set out below. Any request to update, modify or delete the entrant's details should be directed to The Promoter.

  36. 36.

    Salmat IDR, on behalf of Optus Administration Pty Ltd, is collecting the entrant's personal information for the purpose of conducting and promoting this competition (including but not limited to determining and notifying winner). The entrant's personal information may be disclosed to Salmat IDR for this purpose. If you are not willing for this to occur you cannot participate in the Promotion.

  37. 37.

    Entrants' personal information may be disclosed to State and Territory lottery departments and winners' names published as required under the relevant lottery legislation. A request to access, update or correct any information should be directed to the Promoter.

Game Of Skill Optus Small Sided Football Awards Terms And Conditions Of Entry

  1. 1.

    Information on how to enter and prizes forms part of these Terms and Conditions. Entry into the Optus Small Sided Football Awards ("Promotion") is deemed to be an acceptance of these Terms and Conditions.

  2. 2.

    Promotion commences Thursday 12th May 2011 at 9am (AEST) and entries close at Wednesday 31st August 2011 at 11:59pm (AEST) ("Promotion Period").

  3. 3.

    Entry is only open to people over 18 who are Australian residents during the Promotion Period and comply with the eligibility requirements below:

    a). Have a child or dependant who has registered in a Small Sided Football competition between October 1, 2010 - September 30, 2011 (for Lucas Neill Leadership Award category, Most Promising Player Award category and the Team of the Year Award category).

    b). Have coached a Small Sided Football team that is registered and playing in a Small Sided Football competition between October 1, 2010 - September 30, 2011 (for Coach of the Year Award)

    c). For Lucas Neill Leadership Award category, Most Promising Player Award category and the Team of the Year Award category have a current and unique FFA registration number obtained when signing on with their respective club

    d). For the Coach of the Year Award Category the promoter will confirm with the club/FFA that the winner is the registered coach for the period between October 1, 2010 - September 30, 2011

    To enter, Entrants must during the Promotion Period visit optus.com.au/football ("Promotional Website"), correctly complete the online entry form and attach a submission in accordance with the criteria outlined.

  4. 4.

    Entrants can enter more than one award. Entrants must select which award they are entering from the list below.

    a). Lucas Neill Leadership Award Category
    b). Most Promising Player Award Category
    c). Optus Small Sided Football Team of the Year Award Category
    d). Optus Small Sided Coach of the Year Award Category

  5. 5.

    All entries will be subject to post moderation on a daily basis

  6. 6.

    By entering this promotion, Entrants warrant that they have full consent of all parties related to the respective entry

  7. 7.

    Entrants may enter multiple award categories. Each entrant may only submit one entry per award category. Entrants must upload a video or photographic content to support their entry and showcase their football passion. Images will be displayed within the public 'Gallery' section on the site which will showcase all entrants. Entrants address, phone number or email will not be displayed anywhere on the site.

  8. 8.

    Entrants will be required to enter 250 words on why they should win the respective award(s). The 250 words is a mandatory field and must be completed.

  9. 9.

    Entrants uploading video must submit a unique video if they chose to enter more than 1 award. You may not enter the same video for multiple awards.

  10. 10.

    Video content will be uploaded via the YouTube functionality on the Optus YouTube Channel which will be available to be viewed by the public. Once uploaded onto YouTube the video will then be displayed into the optus.com.au/football site and displayed in the gallery. All uploading of video is possible from the optus.com.au/football page.

  11. 11.

    Entrant warrants that they own the intellectual properties rights within the entry including words, images and video

  12. 12.

    All entries submitted become the property of the Promoter. As a condition of entering into this promotion, entrants agree to assign all of their rights, and interest (including copyright) in to their entry to the Promoter and consents to the Promoter using the entry in any manner the Promoter wishes (including modifying, adapting or publishing the entry in whole or in part or not at all), by way of all media, including, without limitation, posting their entry (whether in original form or a modified or adapted by the Promoter as permitted under this paragraph) on the Promoter's website without payment to the entrant (of royalties, compensation or otherwise). This includes any images, including but not limited to photo's and videos. Each entrant warrants to the Promoter that each entry submitted is an original creative work of the entrant, which does not infringe the rights of any third party. Entrants agree to indemnify the Promoter against all costs and claims by third parties arising from a breach of this warranty and consents to any use of their entry which may otherwise infringe their moral rights pursuant to the Copyright Act 1968 (Cth). 8. This is a game of skill and chance plays no part in determining the winner in any Award category.

  13. 13.

    Valid entries for the Team Award will be voted for by users on the site by viewing their entry within the Gallery and clicking the 'Vote' button. The entrants with the most votes will be short listed and the judging panel will select a winning Team from the shortlist.

  14. 14.

    The Judging criteria will be based on entrants who can demonstrate their passion, commitment and creativity for football through their 250 words, image or video.

  15. 15.

    Entries that are, or include, obscene, offensive, defamatory, inappropriate, unsuitable, or infringing content as determined by the Promoter at its sole discretion will be deemed invalid and are not eligible to win. Incomplete or incomprehensible entries will also be deemed invalid and disregarded.

  16. 16.

    All valid entries received during the Promotion Period will be entered into the judging to be on Monday 5th September 2011 at 9am (AEST) and finishing Friday 9th September 2011 at 5pm (AEST) at Optus Centre Sydney, 1 Lyonpark Road, Macquarie Park NSW 2113.

  17. 17.

    The valid entries chosen in each Award category, judged to be the most creative will win pre-determined prizing ("the Prize") including:

    a). Lucas Neill Leadership Award:
    • A training session with Lucas Neill and the winning entrant and up to 20x Small Sided Football players in a to be determined location in Australia at a date to be advised
    • ONE Australian Socceroos jersey signed by Lucas Neill for the winning entrant only

    b). Most Promising Player Award:
    • A training session and the winning entrant and up to 20x Small Sided Football players in a to be determined location in Australia at a date to be advised
    • ONE Australian Socceroos jersey signed for the winning entrant only

    c). Optus Small Sided Team of the Year Award:
    • A $10,000 cash prize for the winning entrant to be used to develop their team or club - Optus reserve the right to approve the use of the prize prior to the cash being provided to the club

    d). Optus Small Sided Coach of the Year Award
    • A training session with a top coach and team for the winning entrant and up to 20x Small Sided Football players in a to be determined location in Australia at a date to be advised
    •The first 200 entries received in the Optus Small Sided Football Team of the Year Award will receive a Small Sided Football equipment pack valued at RRP$320.00 including -
    • 1x Small Sided Football pop-up goal set and carry bag
    • 25x Small Sided Football disc cones and stand
    • 12x Small Sided Football training bibs (sizes are not negotiable and will be decided by the manufacturer)
    • 4x Size 3 footballs
    • 3x Size 4 footballs

    Small Sided Football equipment packs will be mailed to the entrants mailing address provided as part of the entry form up to 45 business days post the entry being received, All winners will be notified via phone. Judges' decision is final and no correspondence will be entered into.

  18. 18.

    In the event that for any reason whatsoever the winner does not take an element of the Prize at the time stipulated by the Promoter then that element of the Prize will be forfeited by the winner.

  19. 19.

    The Prize (including any unused portion) cannot be transferred, exchanged or redeemed for cash. The Promoter retains the right to substitute the Prize with a prize of equal or greater value (including where the Prize is unavailable).

  20. 20.

    Prize values are the recommended retail value and are correct at time of printing. All prize values are in Australian dollars unless otherwise stated. The Promoter is neither responsible nor liable for any change in the value of a prize occurring between publishing date and date the prize is claimed.

  21. 21.

    Except for any liability that cannot be excluded by law, the Promoter (including its officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the Promotion, including, but not limited to, where arising out of the following: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter's control); (b) any theft, unauthorised access or third party interference; (c) any entry or Prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in Prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or entrant; or (f) use of the Prize; (g) any liability for intellectual properties infringement within the entry

    All claims and entries become the property of the Promoter. The Promoter requires your personal information in order to conduct the Promotion. If you do not provide the mandatory personal information requested then you will not be able to take part in the Promotion. By entering this Promotion, each entrant is taken to consent to the Promoter using the entrant's personal information and entry for promotional purposes, to administer the Promotion, announce the winners and disclosing the entrant's personal information to organisations that assist the Promoter with administering the Promotion and announcing the winner, and to third parties as required by law (including authorities that regulate this Promotion). The Promoter is bound by the National Privacy Principles in the Privacy Act 1988 (Cth) and by entering the Promotion, the entrant is taken to consent to the Promoter's privacy policy.
